IJTIHAD UMAR IBN AL-KHATHTHAB DAN MANHAJ IJTIHADNYA
Abstract
Ijtihad of Umar has always been interesting to be studied because in the hand of Umar the flexibility and elasticity of Islamic law to be real. Islamic science is progressing rapidly in the next periods such as during the era of mujtahid Imams: Abu Hanifa, Shafii, Bukhari, Ghazali, and Razi. However, if studied carefully, people will find out that none of those scholars concerned about what was stated by sayyidina Umar.
There were many ijtihad conducted by Umar until now debatable: Had Umar left Quran and sunnah? To what extent are his ijtihad valid? Using primary source of Muhammad Baltajis works: Manhaj Umar Ibn Al-khattab fi At Tasyri, Dirasah Mustauadah li Fiqhi Umar wa Tandhimatih, one will find out that Umar did not deviate from the Quran and Sunnah of the Prophet even otherwise Umar understood deeply the spirit and soul of Islamic law.
Umar manhaj of ijtihad is in accordance with the methodology of Islamic law formulated by scholars of ushul fiqh such as: mashlahat, sad adz-dzariat and others.
